Terms of Service | Linkupnepal Hosting

1. Account Creation

To create an account with Linkupnepal Hosting, customers must provide complete, accurate, and up-to-date information. Account activation occurs only after successful verification and payment confirmation.

2. Payments

Customers are required to make payments for hosting services on a monthly, yearly, or agreed billing cycle. Timely payments are mandatory to avoid suspension or termination of services.

3. Billing & Invoicing

Service Fees

  • Fees are listed on the service description page at the time of purchase
  • Billing begins on the effective service start date
  • Usage-based fees are calculated based on actual consumption
  • All non-usage fees are billed in advance
  • Promotional pricing is non-recurring
  • Setup fees and third-party fees are non-refundable

Invoices

  • Renewal invoices are generated minimum 7 days before service expiry
  • Payment is due by the invoice due date

Late Payments

  • A late fee of 10% or NPR 300 (whichever is higher) will be applied
  • Services suspended after 1 days of non-payment
  • Multiple reminders will be sent
  • Overdue invoices may affect all services under the account
  • In case of unpaid invoices, web hosting services will be terminated and all data will be permanently deleted after 7 days. For other services, the service will be terminated on the overdue date and all associated data will be permanently deleted.

4. Use of Services

Services must be used for lawful purposes only.

  • Spamming
  • Hacking or unauthorized access
  • Hosting illegal, pirated, or abusive content
  • Malware distribution

Violations may result in immediate suspension or termination.

5. Service Uptime

Linkupnepal Hosting strives to maintain high availability but does not guarantee 100% uptime. Downtime may occur due to maintenance, upgrades, or unforeseen circumstances.

6. Data Backup

Customers are solely responsible for maintaining independent backups. Linkupnepal Hosting does not guarantee full data recovery.

7. Meaning of “Unlimited” Services

What “Unlimited” Means

  • No predefined limits for normal personal or small business websites
  • Usage must not negatively impact server stability
  • Customers may be required to upgrade if usage affects performance

What “Unlimited” Does NOT Mean

  • Online storage or backup services
  • Video streaming, torrents, P2P, IRC, or testing environments
  • Enterprise-level workloads

8. Storage & Database Usage

  • Maximum storage of database as per plan
  • Multiple databases allowed within limits
  • Excessive usage may result in restriction or suspension

9. Unlimited File Transfer

There is no limit on visitor traffic or monthly data transfer if usage complies with these terms. Resources may be limited to protect server stability.

10. Unacceptable Resource Usage

  • Cron jobs running more frequently than every 15 minutes
  • MySQL queries exceeding 30 seconds
  • Using 25% or more system resources for over 90 seconds
  • Mailbox size exceeding 5GB per mailbox or 50GB per domain

11. Backups

Nightly backups may be performed for administrative purposes only. Backups are NOT guaranteed. Customers must maintain their own backups. No compensation is provided for data loss.

12. Security Measures

Customers are responsible for:

  • Using strong passwords
  • Securing scripts and applications
  • Protecting login credentials

13. Support Services

Technical support is provided based on the subscribed service plan. Response time and scope may vary.

14. Service Termination

  • Customers may terminate services with prior notice
  • Services may be terminated immediately for violations
  • Data may be deleted upon termination or suspension

15. Refund Policy

Eligibility

  • Refund policy applies only to web hosting plans. Other services are not eligible for refunds.
  • Refund requests must be made within 24 hours of purchase.
  • Third-party services, setup fees, domain registrations, and promotional offers are non-refundable.

Procedure

  • Refund requests must be submitted via support ticket
  • Reviewed within 7 business days
  • Approved refunds processed within 7 days of approved date
  • Refunds issued using the original payment method and bank transfer charge may be apply

16. Limitation of Liability

Linkupnepal Hosting is not liable for data loss, downtime, business interruption, or security breaches. No express or implied warranties are provided.

17. Use of Customer Name & Logo

By using our services, you grant permission to use your name and logo for marketing. Consent may be withdrawn in writing; removal will occur within 30 days.

18. Delivery of Services

  • Services are delivered electronically
  • Order confirmations and receipts are emailed
  • Delivery delays will be communicated

19. Confidentiality

These Terms are governed by the laws of Nepal, and disputes shall be resolved under Nepalese jurisdiction.

22. Right to Refuse Service

Linkupnepal Hosting reserves the right to refuse service to anyone at its discretion.
